OMVIC’s Consumer Survey Contest

Win a $10 Gas Card or a Garmin Nuvi GPS

The OMVIC Consumer Survey contest will be referred to as the “Promotion” throughout this document.

The Ontario Motor Vehicle Industry Council and its agents who are administering the Promotion will be referred to as the “Sponsor.”

 

Terms and Conditions

By filling out the Consumer Survey, you will be entered into a draw for a chance to win a $10 Gas Card. This is a free contest that selects one (1) winner out of every five (5) entrants at random from all eligible entries submitted during the period of the contest. If you have been selected as the winner of a contest, you will be notified through email.

After our notification has been sent, you will have ten (10) days to reply to the notification via email to ascertain the details of claiming your prize; after such time, the offer will become null and void. You only have to enter the contest once to be eligible for all future draws; multiple entries will not be accepted. Once a contestant has won once, they will be removed from the database.

 

How to Enter

    1. The promotion will begin on February 14, 2011 and run until a total of 500 respondents have completed the survey.
    2. All contestants must enter online through the BuyWithConfidence.ca website.
    3. A successful entry is defined as a completed survey with all required questions answered. All comments must be legible and written in English. Entries containing profanity, racial or derogatory remarks will be deleted and ineligible for this promotion. OMVIC reserves the right to moderate entries, comments and eligibility requirements.
  1. Contestants may only enter one (1) time through each email account.
    1. Entries that are fraudulent are not permitted and will be declared invalid.
    2. By submitting a completed survey, contestants agree to be bound by these official rules and regulations and the decisions of the Sponsor, which are final.
    3. If the identity of the contestant is disputed, the prize will be awarded to the authorized owner of the email account at the time of entry.

 

Who Can Enter

  1. The promotion is open to all residents of Ontario who are of the age of majority in Ontario at the time of entry.
  2. The promotion is not open to employees of the Sponsor, and its parent, subsidiary, advertising and promotion agencies.
  3. The promotion is subject to all federal, provincial and municipal laws, and is void where prohibited.

 

The Prize

  1. There is one (1) prize to be won for every five (5) entrants in addition to one (1) grand prize. The prizes consists of:
    One (1) $10 Gas Card for one (1) out of every five (5) entrants.
    1. The prize will be administered through the Sponsor and the winning contestant will receive the prize by mail after responding to the notification email.
    2. The contestant must have a valid email address and postal code in order to claim the prize:
      One Garmin Nuvi GPS for one (1) grand prize winner
      1. The prize will be administered through the Sponsor and the winning contestant will receive the prize by mail after responding to the notification email.
      2. The contestant must have a valid email address and postal code in order to claim the prize.
  1. The prizes must be accepted as awarded and are non-transferable, non-refundable and non-exchangeable.
  2. All respondents must send their intent to accept the prize within ten (10) days of receiving the notification.
    1. The contest winner will be notified by the Sponsor via email to indicate that they have won the prize. Failure to acknowledge this notification for any reason whatsoever within ten (10) days will result in a forfeiture of the prize.

 

The Draw

  1. The Promotion will begin on February 14, 2011 and run until a total of 500 respondents have completed the survey.
  2. During the promotion period, the Sponsor will randomly select one (1) entrant out of every five (5) entrants to win a $10 Gas Card.
  3. One (1) business day following the draw, the selected entrant will be contacted via the email address entered while completing the survey.
  4. After the promotion period, the Sponsor will randomly select one (1) entrant out of 500 to win the Garmin Nuvi GPS.
  5. In order to be declared the winner of the Garmin Nuvi GPS, the selected contestant must do the following within ten (10) days of being contacted:
    1. Sign a declaration stating that he/she has read, understands and complies with the Contest Rules;
      1. Releases and discharges the Sponsor and their respective parents, subsidiaries, affiliates or third party services involved with this campaign; and
      2. Consents to the announcement of the winner's name and the use by or on behalf of the Sponsor of the winner's name, address, photograph, likeness, voice or statements for advertising and promotional purposes without any further compensation to the winner.
    2. Correctly answer a skill testing question.
  6. Should the selected contestant fail to comply with any of the requirements set out in the above paragraphs, the prize will be automatically forfeited and another entrant will be selected by random draw.
  7. The odds of being selected will depend upon the number of eligible entries received.

 

Consent to Personal Information Use and Disclosure

  1. By entering the promotion, participants consent to the Sponsor's collection, use and disclosure of such personal information for the purposes: (1) of administering and publicizing this promotion, (2) set out in these official rules, (3) of detecting and protecting the Sponsor, their affiliates and other third parties against error and fraud and other illegal activity, and (4) as otherwise disclosed to you and for which we obtain your consent as permitted or required by law.
    1. Personal information will not be provided to, stored by or sold to any other organizations outside of the Sponsor and its agencies, affiliates or third-party service providers involved with this campaign.
    2. Contestants consent to the use of their personal information for marketing purposes, specifically, but not limited to, outbound emails.

General Rules/Liability Exclusion

  1. The Sponsor and its parent, subsidiaries and affiliates will not, under any circumstances, be responsible for, or liable to contestants or any other person for:
    1. Any erroneous, lost, damaged, late, incomplete, misdirected, deleted, defective, or altered promotion entries, regardless of the cause;
    2. Any failure for any reason whatsoever of the selected contestant to receive a prize notification email;
    3. Any changes in email address after submissions are entered;
    4. Any damage or loss, including any loss of use, loss of production, loss of profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort, or under any other theory of law or equity, arising from, connected with, or relating to the Promotion or the submission of entries to the Promotion or participation in the Promotion or the Promotion prize, the use of the Promotion website and regardless of the cause or any negligence by the Sponsor or anyone for whom the Sponsor is responsible, and notwithstanding that the Sponsor may have been advised of the possibility of such loss or damage being incurred.
  1. You agree that you will not use any robot, spider or other automatic device, process or means to access the survey website. Nor shall you use any manual process to monitor or copy our web pages or the content contained thereon or for any other unauthorized use. You agree that you will not use any device, software or routine that interferes with the proper working of the campaign website nor shall you attempt to interfere with the proper working of the campaign website. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure.
  1. Promotion Sponsors assume no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. If for any reason, in the opinion of the Promotion Sponsor in its sole discretion, the promotion is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the promotion is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, the Promotion Sponsor reserves its right to cancel, terminate, modify, amend, extend or suspend the promotion including canceling any method of entry, and select a winner(s) from previously received eligible entries. The Promotion Sponsor reserves its right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the promotion or to be acting in violation of these terms and conditions or otherwise in a disruptive manner. Promotion Sponsors reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution for any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion.
